Supreme court lauds Raina’s efforts in helping people with disabilities

On Friday, August 14, 2026, the Supreme Court closed the criminal proceedings that were held against Indian comedian Samay Raina and four other social media personalities over their Latent controversy last year, which included remarks concerning people with disabilities. The court has now appreciated their efforts to promote awareness and dignity for the community.

Along with Raina, the court also dismissed the FIRs against other comedians Vipul Goyal, Balraj Paramjeet Singh Ghai, Sonali Thakkar, and Nishant Jagdish Tanwar.
The controversy began with the jokes made by the five comedians, which were flagged by the M/S SMA Cure Foundation. This organisation works with people affected by Spinal Muscular Atrophy and various other rare diseases.

The Turn in the Case
However, the case took a sudden turn when the Supreme Court ordered the five comedians to take constructive and thoughtful steps to help people with disabilities. Since then, it had come to the attention of the court that in March they had organised a chess tournament for the specially abled people and went on to help raise awareness about organisations that are working with people with disabilities.
The respondents had also proposed four additional fundraising shows. However, due to logistical issues, they couldn't invite the people with disabilities to their shows in order to raise awareness; they expressed their willingness to involve persons with SMA and provide financial support.
Further Reparations
The Court noted that a constructive and helpful dialogue had taken place between the respondents and the petitioner Non-Governmental Organisation (NGO), Cure Foundation. The parties had discussed programmes that were aimed at spreading awareness about Spinal Muscular Atrophy (SMA) and celebrating the lives and achievements of the "SMA warriors." The respondents have also agreed to seek the guidance of the NGOs while continuing with these projects and to take the consent of the SMA warriors for their participation in any event.
The bench has appreciated their efforts and further said that the respondents were expected to continue with such efforts that promote dignity and raise awareness of people with disabilities.
AdvertisementThe court’s decision thus brings the criminal proceedings against the five comedians to an end. The Court stated that it will keep the petition filed by Cure Foundation pending to consider the larger issue on the need for rules to prevent the humiliation of persons with disabilities.
The bench has further called for suggestions from persons with disabilities and the petitioner NGO before issuing directions.
